These Terms of Use govern access to and use of the MyTS platform, provided by MyTS Ltda., registered in Brazil under CNPJ number 99.999.999/9999-99, with its registered office at Avenida das Nuvens, 404, 12th floor, Bairro Horizonte, São Paulo/SP, Brazil, postal code 00000-000, referred to as “MyTS,” “we,” “us,” or “our.”

By accessing or using MyTS, you confirm that you have read, understood, and agreed to these Terms.

1. Eligibility and authority

You must have the legal capacity to accept these Terms. If you use MyTS on behalf of a company or another organization, you represent that you have authority to bind that organization to these Terms.

2. Registration and accounts

Some features require an account. You agree to provide accurate, complete, and current information, keep your credentials secure, and prevent unauthorized access.

You are responsible for activities performed through your account. If you suspect misuse or unauthorized access, please contact us immediately.

3. Acceptable use

You may use MyTS only for lawful purposes and in accordance with these Terms, applicable law, and the internal policies of the organization associated with your account.

You must not:

• use the platform for illegal, fraudulent, or abusive activities;
• access accounts, data, or systems without authorization;
• interfere with the security, availability, or operation of MyTS;
• transmit malicious code or perform unauthorized security testing;
• copy, modify, sell, or commercially exploit the platform without our authorization;
• use automated mechanisms to extract data unless expressly permitted.

4. User content and data

You remain responsible for the information, documents, and other content submitted to MyTS, including its legality, accuracy, and any permissions required for its processing.

You grant us limited permission to host, process, reproduce, and transmit such content only as necessary to operate, protect, and improve the contracted services.

5. Privacy and data protection

Personal data associated with MyTS will be processed in accordance with our Privacy Policy, applicable agreements, and data-protection laws.

If your account is managed by an organization, that organization may control your access and certain account information, subject to the relationship between you and the organization.

6. Intellectual property

MyTS, including its software, visual identity, interfaces, trademarks, text, and other components, belongs to MyTS Ltda. or its respective licensors.

These Terms provide only a limited, revocable, non-exclusive, and non-transferable right to use the platform. No intellectual-property rights are transferred to you.

7. Third-party services

MyTS may integrate with or provide links to third-party services. Those services have their own terms and policies, and their use may require acceptance of separate conditions.

We are not responsible for third-party services outside our control, except where liability cannot be excluded by law.

8. Availability and changes

We will seek to keep MyTS available and secure, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, and changes required for the platform’s security, performance, or development.

9. Suspension and termination

We may suspend or restrict access in the event of a breach of these Terms, a security risk, contractual non-payment, or a legal obligation.

You may stop using MyTS at any time. Termination of an account managed by an organization may require a request from that organization or be subject to the applicable commercial agreement.

10. Limitation of liability

To the extent permitted by law, we will not be liable for indirect damages, loss of profits, loss of opportunities, or losses caused by events outside our reasonable control.

Nothing in this section excludes liability that cannot legally be limited, including liability arising from fraud, intentional misconduct, or violation of non-waivable rights.

11. Changes to these Terms

We may update these Terms to reflect legal, technical, or operational changes. When a change is material, we will provide reasonable notice through the available channels.

Continued use after the new version becomes effective will constitute acceptance where permitted by law.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo, State of São Paulo, Brazil, shall have jurisdiction, unless applicable law requires another venue.

13. Language

These Terms may be provided in other languages. If there is any conflict between translations, the Brazilian Portuguese version will prevail, unless otherwise required by law.
